1. Acceptance of Terms
By downloading, accessing, or using the DEMT mobile application or service platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Platform.
2. Scope of Services
DEMT operates an on-demand technology platform connecting vehicle owners ("Customers") with third-party independent mechanics and roadside service providers ("Mechanics"). DEMT is a technology dispatch platform and does not directly provide automotive repair services unless explicitly specified.
3. User Accounts & Verification
- Account Creation: Users must be at least 18 years of age to register an account. You agree to provide accurate, complete, and updated profile details.
- Security: You are responsible for safeguarding your authentication credentials and maintaining continuous control over your account.
4. Booking, Emergency Dispatch, & Dynamic Pricing
- Standard Dispatch: Requests are matched based on location, availability, and service type.
- Emergency Dispatch: Requests designated as emergencies incur additional surge/emergency fees as set by platform administrators. Emergency requests route through prioritized spatial matching and acceptance windows.
- Service Availability: While the platform utilizes automated dispatch algorithms, DEMT does not guarantee immediate mechanic availability for all geographic areas or request types.
5. Payments, Fees, & Taxation
- Payment Processing: All payments, authorizations, and disbursements are processed securely via Stripe. By adding a payment method, you authorize DEMT to charge all applicable service fees, parts costs, emergency surcharges, and taxes.
- Parts & Labor Breakdown: Charges are itemized into base labor fees, physical parts/materials costs, and platform fees.
- Cancellation Policy: If a booking is canceled after matching outside the designated grace window, a cancellation penalty may be assessed and charged immediately or applied as a debit balance to your next booking session.
- Taxation: US state, county, and local sales taxes are calculated at checkout based on localized jurisdictional rules and itemized service breakdowns.
6. Mechanic Independent Contractor Relationship
Mechanics operating on the Platform are independent contractors, not employees or direct agents of DEMT. Mechanics are required to accept the platform's safety guidelines, industry standards, and terms of service prior to accepting a job.
7. Disclaimers & Limitation of Liability
- "As-Is" Basis: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.
- Limitation of Liability: To the maximum extent permitted by applicable US federal and state law, DEMT shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of vehicle repairs, service delays, or platform downtime.
8. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States and the State in which service is requested, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved through binding individual arbitration rather than class action lawsuits.
